Despite Mental Health Treatment, Terry Storey Remains Incompetent To Stand Trial

(Lawrenceburg, Ind.) – Criminal proceeding against Terry Wayne Storey were stayed on Thursday as he remains unfit to stand trial.

The 57-year-old from Manchester is accused of killing his next door neighbor, Brittany Black, as she mowed her lawn in July of 2017. Storey then allegedly shot Kyle Black as he came to check on his wife. Kyle was seriously wounded but survived the shooting.

Storey was consequently arrested and charged with Murder, Attempted Murder (level 1 felony), Aggravated Battery (level 3 felony), Obstruction of Justice (level 6 felony), Battery on a Public Safety Official (level 6 felony) and Resisting Law Enforcement (class A misdemeanor).

However, Dearborn Circuit Court Judge James D. Humprey found Storey to be incompetent to stand trial on December 5, after two independent psychiatrists found he lacked the ability to understand the proceedings or assist his lawyer in his defense.

The Indiana Division of Mental Health and Addiction has since been providing mental health treatment to Storey with the goal of restoring him to competency. According to Dearborn-Ohio County Prosecuting Attorney Lynn Deddens, Storey has failed competency tests on two separate occasions since starting treatment.

"This is disappointing for us, because we want to get justice for the victims," Deddens said. "Unfortunately, the state authorities continue to say Mr. Storey is incompetent. We look forward to the day when he is certified as competent, so we can get him in front of a Dearborn County Jury and hold him accountable for what he did.''

Judge Humphrey has ordered that Storey’s status be updated every 180 days. If mental health treatment is successful, Storey will be returned to Dearborn County for trial.

Until then, Storey remains in custody at Logansport State Hospital.
