Couple Found With Heroin, Kid In Vehicle

A witness called 911 after reportedly seeing the couple "nodding off" inside a vehicle parked at the Walmart in Aurora.

(Aurora, Ind.) - An Aurora couple is facing charges after they were found “nodding off” and in possession of heroin in the parking lot of the local Walmart.

A witness called 911 on Tuesday, April 17 after noticing a man and woman nodding off in a Jeep Cherokee parked near the supercenter’s front entrance. A child was seen in the vehicle with them.

Aurora Police came and found 36-year-old Kelly J. Foster in the vehicle’s driver seat and 40-year-old John D. Foster in the passenger seat. A nine-year-old girl was in the back seat.

Officers did not observe any obvious signs of impairment and the couple was able to carry on a conversation with them. They asked for consent to search the vehicle, which the Fosters agreed to.

Found in John Foster’s pocket was a tobacco container holding several orange papers with heroin inside, two razor blades, and a clear-cut straw. Foster acknowledged the substance was heroin.

Searching through the vehicle, officers found another tobacco container between the drivers seat and middle console. It held more orange papers with more heroin and a cut straw.

Despite her proximity to the drugs found next to the driver seat, Kelly Foster denied ownership of the drugs.

The Fosters were arrested and charged with Possession of a Narcotic Drug (level 6 felony), Neglect of a Dependent (level 6 felony), and Possession of Paraphernalia (class C misdemeanor).

The girl in the car with them was placed with a relative by an Indiana Department of Child Services case manager.

The couple appeared in court on Wednesday, April 18. John Foster was ordered held on $10,000 cash bond. Kelly Foster posted a $750 cash bond to be released from jail on April 20.
